Anyone who has been adversely affected by sterility problems could be entitled to pursue a claim for personal injury compensation on a No Win, No Fee basis.

As a firm of specialist Group Action Lawyers, we have represented many victims for issues concerning the sterility of equipment and devices, and there have been plenty of regulatory recalls over the years where this has been the issue.

A single event or a prolonged problem where an issue over sterility occurs could lead to thousands of people being put at risk. Anyone who has ever suffered harm in this way could be entitled to pursue a claim for damages.

Claiming compensation for sterility problems

In many instances, sterility problems can affect a large number of people whilst originating from a single event. It could be that a batch of medical implants or injections have not been properly sterilised, or there could be contamination concerns or worries over whether sterility can be proven for medicines.

There have been many regulatory recalls over the years where sterility has been the core of the problem. The result can be that people are exposed to harm from being exposed to non-sterile equipment or devices and drugs that are used for treatment, some of which can be invasive. This could lead to adverse health effects.

Anyone who has been affected by an issue of this nature could be entitled to pursue a claim for personal injury compensation. We may be able to offer No Win, No Fee legal representation if we believe that a victim has been harmed through negligence.

A recent example

A recent example of sterility problems that resulted in a company-led recall, as published on the MHRA (Medicines and Healthcare products Regulatory Agency) website, involves East Suffolk and North Essex NHS Foundation Trust. They are reportedly recalling “Glucose 10%w/v injection 10mL and Trometamol 7%w/v injection 5mL” batches due to what has been described as “limited assurance of product sterility.”

Whilst this may be just a precautionary measure, if any non-sterile batches are used, there are genuine concerns over whether people could be adversely affected.

It is understood that the regulators and the company involved will be able to fully trace all the batches that are being recalled. Hopefully, no one will come to any harm.

An example of settled cases

When it comes to sterility problems, one of the most infamous events of recent times that resulted in one of the biggest NHS recalls in history was the Desmond D’Mello scandal. The former dentist had been practicing at Daybrook Dental Surgery for decades when a whistle-blower filmed him failing to adhere to important cross-infection protocols. This included using equipment that was not sterile, with his actions putting some 22,000 people at risk of contracting serious infections.

We have settled compensation claims arising from the scandal, and we continue to represent some of those affected.
